We act for Employers and Employees in the Employment Tribunal and Employment Appeal Tribunal. We can take on your claim or help you defend a claim from start to finish.  If you already have a claim, we can assist you at any stage of it.

Fee Transparency

Our charges vary due to the type of claim, number of witnesses and time required. We have two charges: legal fees and disbursements. Our fees attract VAT which is chargeable at 20% of any of the fees shown below.  This means 20% is chargeable on top of the hourly rates and disbursement prices below.

 

 

  • Disbursements are costs related to the claim:
  • 25 pence per page for photocopying;
  • Postage (either Royal Mail or courier services);
  • Travel if applicable at 45 pence per mile;
  • Hotel accommodation if required;
  • Barrister’s fee if applicable.

Typically a wages claim takes us on average between 20 - 25 hours.

Unfair Dismissal/ Constructive Dismissal

Typically an unfair dismissal or constructive dismissal claim (with no discrimination) takes us between 25 - 35 hours.

Our hourly rates are £250 plus VAT

Unfair dismissal / Constructive dismissal

 

Unfair dismissal applies where the Employer dismisses and Employee.  Constructive dismissal applies where the Employee resigns in response to something serious the Employer has done.

Discrimination Claims

Typically a discrimination claim (which usually includes either an unfair dismissal or constructive dismissal claim) takes us on average 30 - 40 hours.

Our hourly rates are £250 plus VAT

With discrimination claims it is standard to have a preliminary hearing scheduled by the Employment Tribunal to prepare the case for a final hearing and prepare a list of issues (questions for the Employment Tribunal to consider at the final hearing).

Preliminary Hearings / Final Hearings


With some claims it is standard for the Employment Tribunal to schedule a preliminary hearing.  However, preliminary hearings can also be used for applications, such as an application to amend the claim or defence, applications to strike out a claim or defence. We offer fixed fees subject to the type of Preliminary Hearing needed.

Final Hearings / Preliminary Hearings

We can act for you in your final hearing and conduct the advocacy for your claim.  We can also instruct barristers to represent you in the final hearing.

The fees are usually fixed fees of a brief fee (preparation and the first day of attendance) and then refresher fees for additional days needed.  Fees are subject to the type of claim.

The fees shown above cover all of the work in relation to the following key stages of a claim, subject to when you appoint us to help and act for you.

  • Taking your initial instructions, reviewing the papers and advising on the merits of the claim/defence, which would include the level of compensation which could be awarded if applicable.
  • Entering into pre-action correspondence and/or talks with ACAS (known as Early Conciliation). This is typically to see if the claim can be settled.
  • Preparing the claim or defence.
  • Reviewing and advising on the claim or defence from the other side.
  • Preparing the case management of the claim (collating documents, preparing bundle of evidence, assisting with witness statements).
  • Preparing a Schedule of Loss or Counter Schedule of Loss subject to which party we represent.
  • Corresponding with the other party and the Employment Tribunal throughout; this can include settlement discussions with the other party.
  • Preparing and attending any preliminary hearings as applicable.
  • Preparing for the final hearing.

Frequently Asked Questions

An Employment Tribunal is a legal system specifically designed to hear complaints between Employees and Employers.  

A claim is submitted on a form called an ET1 and the details of the claim (the particulars) can be included in the form or attached separately, subject to how much detail is given,

If you have received a claim form (called an ET1) you need to submit a defence (called an ET3) within set time frames. The Employment Tribunal’s letter (Notice of a Claim) will confirm you have 28 days from their letter.

It is not a quick process regardless of where in the Country an Employment Tribunal claim is lodged.  It could take well over 12 months although the Employment Tribunals do try to work within a six to twelve month time frame.

No but as it is a legal claim, any party in involved in an Employment Tribunal is going to be in a stronger position with a solicitor acting for them.
